Notice of Information Pertaining to Court ("Fairness") Hearing of March 31, 2020

Be advised that because of the various shut-downs and restrictions imposed by reason of the COVID-19 public health emergency, the New Jersey Courts have minimized or eliminated most ‘in-person’ Court Hearings.  Presently scheduled before the Court, pursuant to the Court’s Order dated 2020-01-30 in the matter of Docket No. PAS-L-2396-15, which order and hearing were publicly noticed, is a hearing, commonly known as a “Fairness Hearing” scheduled to take place on MARCH 31, 2020, before the Honorable Thomas F. Brogan, P.J.S.C. at the Passaic County Courthouse, 77 Hamilton Street, 3rd Floor, Paterson, New Jersey 07505.

That hearing is for the purpose of addressing two proposed settlement agreements: one involving K. Hovnanian North Jersey Acquisitions, LLC, for the proposed, inclusionary development of property within the Township designated on the Township’s official tax maps as Block 3305, Lots 4, 5 and 6, which property is otherwise known as the Rock Ledge Property (the “Rock Ledge Settlement Agreement”) and the second involving Wayne Property Holdings, LLC, for the proposed, inclusionary development of property within the Township designated on the Township’s official tax maps as Tax Block 2329, Lot 1 and Lot 1 QFARM (formerly Lot 17), and Tax Block 2327, Lot 21.01, which property is otherwise known as the GAF Property (the “GAF Settlement Agreement”).

Be advised that as of March 30, 2020, the Court has advised that the Fairness Hearing remains scheduled to take place on MARCH 31, 2020, however, the time of the hearing has been changed to 10:30 AM.  Consistent with the policy adopted by the New Jersey Supreme Court, that hearing shall take place using ‘virtual technology’ that has been adopted for use by the Court system.

A member of the public wishing to observe, object, or otherwise participate in that ‘Fairness Hearing’ may either:
  • a. appear at the Passaic County Court House for the scheduled date and time and advise his/her intent; the Court will endeavor to permit, but cannot assure, the use of a Courthouse computer that will have access to the virtual hearing; or
  • b. gain ‘on-line’ access to the Court’s ‘Virtual Courtroom,' the Court will endeavor to provide but cannot assure access to the Virtual Courtroom system. For that purpose, the Court has provided the following information for access
